§ 1 Scope and contracting party
These Terms and Conditions apply to all orders placed through our online shop peruviancultures.com.

A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
Deviating terms of the customer do not become part of the contract unless we expressly agree to them in writing.
§ 2 Conclusion of contract
The presentation of products in our online shop does not constitute a legally binding offer, but a non-binding invitation to order.
The order process comprises the following steps:
1. Selecting the desired goods and adding them to the cart
2. Opening the cart and reviewing the selection
3. Entering delivery and billing details
4. Selecting the payment method
5. Reviewing all details on the order summary page
6. Placing a binding order by clicking the "Pay now" button or, when paying with PayPal, by confirming the payment on PayPal
By submitting your order you make a binding offer to conclude a purchase contract. We will confirm receipt of your order by email without undue delay. This confirmation of receipt does not yet constitute acceptance of your offer.
The purchase contract is concluded when we accept your order by separate order confirmation by email or dispatch the goods, at the latest upon delivery of the goods to you.
§ 3 Correction of input errors
Before submitting your binding order, you can review all entries at any time and correct them using the usual keyboard and mouse functions as well as your browser's "Back" button. On the order summary page, all details are shown again and can be changed before submission.
§ 4 Storage of contract text and contract language
We store the contract text of your order. The order details and these Terms will be sent to you by email together with the order confirmation. After the order has been submitted, the contract text is no longer accessible via our website; we therefore recommend that you keep the order confirmation.
Contracts may be concluded in German and English.
§ 5 Prices – all taxes, duties and shipping included
All prices stated are final prices in euros (EUR) per item.
The stated price includes all taxes, customs duties and import charges as well as shipping costs. For deliveries within the European Union, no further costs are incurred by you. In particular, no import VAT, customs duties or handling fees are payable to the delivery service on receipt.
We ship exclusively on a duty-paid basis (Incoterm DDP – Delivered Duty Paid). All import charges are paid by us in advance.
§ 6 Payment terms
We offer the following payment methods: PayPal and credit or debit card (processed via PayPal). The purchase price is due for payment immediately upon conclusion of the contract.
§ 7 Delivery and delivery times
Shipping is from Arequipa, Peru, by DHL with tracking. Shipping is free of charge for you. Orders are prepared within 2 business days. Estimated delivery time after dispatch:
Europe, USA and Canada: 5–10 business days
Rest of the world: 7–14 business days
Minor delays due to customs clearance are possible; as we ship duty paid, no additional costs arise for you as a result.
All our textiles are handmade, one-of-a-kind pieces. If an ordered item is unavailable, we will inform you without undue delay and refund any payments already made immediately.
§ 8 Duty-paid shipping (DDP)
We handle all customs clearance and pay all applicable import charges, customs duties and handling fees. You receive your order without any additional payment to the carrier or customs authority.
Should a delivery service nevertheless request payment from you, please do not accept it and contact us immediately at peruvianculturesperu@gmail.com. We will resolve the matter and refund any amounts paid in error in full.
§ 9 Right of withdrawal
Consumers have a statutory right of withdrawal of fourteen days. Please see our Refund Policy at peruviancultures.com/policies/refund-policy for details, which is also sent to you with the order confirmation.
Please note that in the event of withdrawal you bear the direct cost of returning the goods to Peru. The amount of these costs is stated in our Refund Policy.
§ 10 Retention of title
The delivered goods remain our property until payment has been made in full.
§ 11 Warranty (liability for defects)
For consumers, the statutory warranty under §§ 437 et seq. of the German Civil Code (BGB) applies. In the case of defective goods you are entitled to subsequent performance (repair or replacement), a reduction of the purchase price, or withdrawal from the contract. The statutory warranty period is two years from receipt of the goods. If a defect becomes apparent within one year of receipt, it is presumed to have existed at the time of receipt, provided this presumption is compatible with the nature of the goods or the defect.
All our products are handmade, unique pieces. Minor variations in colour, dimensions and pattern compared to the product photos are inherent to the product and do not constitute a defect. In the case of vintage textiles, signs of age and use are part of the character of the goods; we point out significant signs of use in the respective product description.

§ 12 Limitation of liability
We are liable without limitation in cases of intent and gross negligence, as well as under the provisions of the German Product Liability Act and for injury to life, body or health. In the case of slightly negligent breach of a material contractual obligation (cardinal obligation), liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slightly negligent breaches of duty is excluded. The above limitations of liability do not apply to claims under the statutory warranty pursuant to § 11.
§ 13 Products and presentation
Certain products are available exclusively online through the website. We endeavour to display the colours and images of our products as accurately as possible, but cannot guarantee exact colour reproduction on your screen. We reserve the right to restrict the sale of our products to certain geographical regions and to limit the quantities of products offered, insofar as statutory provisions do not preclude this.
§ 14 Accuracy of billing and account information
You undertake to provide current, complete and accurate purchase and account information for all purchases and to update it promptly in the event of changes. We reserve the right to refuse orders for objective reasons or to limit the quantity purchased per person, household or order, in particular where commercial resale is suspected. If your order is changed or cancelled, we will inform you using the contact details provided with the order.
§ 15 Use of the website
By agreeing to these Terms you confirm that you have reached the age of majority in your state of residence. You may not use our website for unlawful purposes, violate any applicable laws or third-party rights, distribute malicious software, collect third-party personal data, engage in spam or phishing, or circumvent security features. You undertake not to reproduce, sell or commercially exploit any part of our content without our express written consent.
§ 16 Accuracy of information
We do not warrant that the general information provided on this website is accurate, complete or up to date at all times. The content serves general information purposes. This limitation does not apply to the legally required information on products, prices, shipping costs and your consumer rights.
§ 17 Changes to the offering and prices
The prices of our products may change without prior notice. We reserve the right to change or discontinue our offering at any time. Contracts already validly concluded remain unaffected; the price displayed at the time of the order applies in each case.
§ 18 Links to third-party websites and optional tools
Links to third-party websites are provided for information only. We accept no responsibility for third-party content, products or services. Please review the policies of the respective providers before entering into transactions with them. The use of optional third-party tools, which we neither monitor nor control, is at your own risk.
§ 19 User comments and reviews
If you submit reviews, suggestions or other content to us, you agree that we may publish and use it. You warrant that your content does not infringe third-party rights and contains no unlawful, offensive or harmful material. We reserve the right to remove content that violates these Terms.
§ 20 Personal data
The submission of personal data through the shop is subject to our Privacy Policy.
§ 21 Errors, inaccuracies and omissions
Should information on our website contain obvious typographical errors, inaccuracies or omissions, for example regarding product descriptions, prices or availability, we reserve the right to correct these. In the event of an obvious pricing error we are entitled to refuse acceptance of the order; in that case we will refund any payments already made in full and without undue delay.
§ 22 Severability
Should any provision of these Terms be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
§ 23 Term and termination
These Terms apply until terminated by you or by us. In the event of breaches of these Terms we may terminate your use of our website; purchase contracts already concluded remain unaffected.
§ 24 Governing law and dispute resolution
These Terms are governed by the law of the Republic of Peru. If you are a consumer with habitual residence in a Member State of the European Union, this choice of law does not deprive you of the protection afforded by the mandatory consumer protection provisions of the law of your place of habitual residence (Art. 6(2) Rome I Regulation).
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 25 Changes to these Terms
We reserve the right to amend these Terms by publishing updates on our website. For orders already concluded, the version valid at the time of the order applies.
